Supreme Court refuses to stay order on Rajasthan High Court order

New Delhi. The Supreme Court has refused to stay the decision of the Rajasthan High Court while awarding a petition filed by the Speaker of Rajasthan Assembly CP Joshi in the Supreme Court.

The petition filed in the Supreme Court on behalf of the Rajasthan Legislative Assembly challenged the order to adjourn the anti-defection proceedings against former Rajasthan High Court Deputy Chief Minister Sachin Pilot and 18 Congress MLAs till July 24.

A division bench of Justice Arun Mishra, hearing the petition, said that the Rajasthan High Court can pass orders on the petition of Congress MLAs against the notice of disqualification of the Rajasthan Legislative Speaker.

Significantly, in Rajasthan, 18 rebel Congress MLAs including former Deputy Chief Minister Sachin Pilot, the Speaker of the Legislative Assembly had issued a notice in two days. For this, a petition was filed in the Rajasthan High Court on behalf of Sachin Pilot and his supporting legislators, demanding a stay on the Speaker's action.

On 24 July, the High Court, while giving its verdict on this petition, stayed any action by the Speaker of the Assembly against Sachin Pilot and his supporting MLAs.

Assembly Speaker CP Joshi had filed a petition in the Supreme Court against the High Court's decision, seeking a stay on the High Court's decision. Which was heard in the Supreme Court today and the court refused to stay the decision of the High Court.
