New Delhi: A Delhi court on Thursday dismissed the applications seeking to produce former Jawaharlal Nehru University (JNU) student Umar Khalid and activist Khalid Saifi, arrested in connection with the Khajuri Khas FIR for Delhi riots, before it in “handcuffs” and sought explanation from Delhi police for moving such plea.
Contending that Umar and Khalid are “high-risk prisoners”, the applications were filed by incharge, lock-up, Karkardooma district courts reportedly after a decision was taken in the matter by senior police officers of Delhi Police, PTI reported.
According to Bar and Bench, additional sessions judge Vinod Yadav said, “The instant applications are completely bereft of the reason(s), prompting the senior police officer(s) to take a decision to move such application(s). For want of material/reason(s) in respect of the applications in question, this Court is at a loss to consider the grant of prayer(s) in these applications.”
During the hearing, special public prosecutor (SPP) Manoj Chaudhary was asked about the meaning of “high-risk prisoner” and that where the same has been defined, whether in the jail manual or Punjab Police Rules or the circular(s) issued by Delhi Police.
To this, the SPP submitted that he was not aware of the instant applications and, therefore, he could not take instructions in the matter.However, Umar and Khalid were already granted bail in the Khajuri Khas riots case. Therefore, the court presumed that the bail orders of applicants are in the knowledge of senior police officers of Delhi Police.While Saifi was granted bail in the case in November last year, Khalid was granted the relief earlier this month.
The Khajuri Khas FIR was registered with respect to the violence that broke out at the main Karawal Nagar Road, near Chand Bagh Pulia on February 24, 2020.However, the accused are in jail as they were arrested in another case related to the criminal conspiracy, lodged under stringent Unlawful Activities (Prevention) Act and other sections. The case will be heard on May 6.
